Hi guys thought I'd give you overseas ppl's the verdict.

The party Rocked albeit some legal issues that the promoters experienced with the venue.

I spoke to the guys on the door and the actual promoters themselves



Hows this !!! The Venue owners of the SKD(the duke) Club in Melbourne ran us out of the venue for No legal Reason!!!!!!!!! Their so called Reason of them doing it was that they weren't making enough money on the bar!!!!! Mind you everyone was drinking and it looked as if they just didn't really appreciate good music and a good HAPPY VIBE! There were no police issues, no noise complaints, no damage to the venue and no patron problems whatsoever on the night. The brother of the Publican/Owner of the venue made the decision that he wanted us to shut early even though we had paid in full upfornt cash for the time advertised. The promoters had a lawyer onsite advising that they had no legal right to do this at 4 in the morning. Under a legal contract if the venue is paid for they have to stay open till the end of the booking, well thats obvious to anyone I'm sure. soooooooo I end my post with
Legal law matters will consist of Breach of contract and sexual harrasment by the owners brotha of something !!!!!!!

Nah... you can sue their ass off, I have seen it done even once to the local government because the promotor booked a government owned building in which later then said no you can't have it...

My AU$0.022 (inc. GST) as a law student / aspiring lawyer:

You can sue, and you do have a good case to present, but litigation is a very expensive endeavour. From what little you've told, all you can hope to recover through litigation is what you paid for the venue pro-rata'd to the length of time that you were allowed to use it, and whatever expenses you incurred in reliance on the specific performance of the contract (prepaid labour etc). I doubt it would cover the legal expenses.

Hopefully though, the simple threat of litigation will be enough for them to cough up some compensation of some kind. That, or they develop some kind of conscience and do it out of respect for their fellow man.

(I assume that the contract in question has no 'backdoor' escape-of-liability clauses and the like. If it does, then you're probably screwed.)
