That line basically guards him from that.
If people don't read the description that's their fault, eBay is already buyer beware as is.

It's complicated, since the title has to say what it is. And in this case it's wrong, because what you get is not a Nokia N900 but nothing.

You're supposed to buy an item off eBay full well knowing what you're buying. Thus, a good seller always lists everything in it's description. Which he did, and in which he explained there wasn't any item at all.

by chance did anybody check his feedback? he has 3 previous positive posts thanking him for a transaction on the same item! i'm sure those are his friends and they are in on the prank. and this isn't big enough for any legal action ebay will just cancel the transactin, maybe refund the money to the dumbass bidder if he was stupid enough to pay for it, and then maybe go as far as cancelling this seller's ebay acct.
