eg i set up a website and on the home page a well known hardcore tune plays. can i get away with this without having to pay royalties?

whether it's legal or not and whether you can get away with it are two different things ... really, if you get busted playing the music as background filler for a website that isn't generating a whole heap of money then i'm sure all you'll get is a polite kick in the ass and be told to go your merry way, minus the music. i mean, how many trance sites are there that have alice dj playing in the background, and how many do you think actually licensed the track?

on the other hand, if the website is bit of a money-spinner for you then maybe they'll ask for some back-royalties or whatever, but remember that royalties are always a percentage of total monies generated by the project. if you only made a few quid off it then you're not gonna have to pay all that much back.

just to be sure to not piss the copyright owner off, be sure to use only a limited clip of the track on loop, with pretty low resolution (this might make it quicker to load as well :P), and credit the artists in a prominent part of the home-page, making sure to include catalog numbers and other details JIC someone wants to buy the song.

DISCLAIMER: i'm not a lawyer. i'm only 1/2 way there. the 1/2 way i still haven't learnt may include that part where they give you a vacuum enema and suck your spleen out of your ass as punishment for copyright infringement. don't take my word as gospel. if you're not sure, get proper advice.
