I will also add that logic might work on paper but real life doesn't always work in a logical way. There is definitely a big difference between stealing melodies/vocals/etc. and sampling a kick.

well, I dont really know about "middle ground"
an artist uses the same colour paints to create a different picture - its still art and they havent technically "stolen"
even if the other artist has mixed those colours themselves.
if you just take a photo of someone elses canvas, throw it into photoshop and adjust the RGB levels and post it on the internet as your own thats a whole new kettle of fish
the middle ground you're saying doesnt exist of is more like "no mans land"
the line of distinction is purely common sense, the more effort that has been put in, the more it is an individual piece of work.
brings things around to a Theseus' paradox ;)

Here is my honest and selfish personal view.
I care about hardcore music therefore I buy all the tracks, albums etc to help and maintain the scene.
I dont really have any sort of affinity for a 60's hip hop artist therefore ripping a drum sample doesn't make me feel guilty what so ever.
A very simplistic view and massive double standards I know, thats just how I feel.

piracy is only there because of piracy law, which is only there so big labels can make the most amount of money possible, hence why i personally dont give 2 shites about the big music industry cos ultimately its just a money spinner, and a lot of the pop artists havent wrote their own music anyway, so **** em.
on the other hand the hardcore scene is completely different, its a lot more difficult to make a classic hardcore tune thats going to be remember for years, just because it all has the same basic components. thats why i think its a bit more of a nono to rip classics off, if you do it respectfully and talk to the original artist then its not going to be such a problem.
thats my opinion on it anyways
