I think a better idea is to ask the artists - see what they think of the tracklists.
All the other rules are sensible, but frankly not posting the track lists seems stupid - how is someone going to buy a track they like if they don't know what it is? reduces sales IMO.

Ask the artists for each indvidual mix!? That'd be a bit clunky, dont ya think?

This should answer a few of your questions:
You make a demo CD for your DJ skills and NOT for the tracks on there... sure the track selection is part of DJing and part of the process of DJing. The fact of the matter is that if you are giving your mixes to other people to listen to then they are listening for the matter of checking your DJ skills and not nessarly the tunes in the mix.
In saying that if you post a track list then people will download the set based apon the track's contained in the track list. That does not help hardcore artists at all. I agree with the point of new hardcore tunes and the producers of those tunes want other people to hear them but that aint fair for the rest of the artists inside your mix...
I modified the rules to include the fact that if you own the copyright to all the tracks in your mix you can do whatever you want with it.
This is what I based the mix rules on... thoughts please.

Haha no that's not what I meant! I mean ask them once, in general what they think about it? People seem to think they wouldn't mind - so if we found out that for sure, they'd be no problem would there? :)

I can see what you are saying here.. but I still think that you've got to include the tracklist. I don't think people would search out a mix to get a specific track if you're implying something like that. If you give someone a mix cd, and they don't know the track names, they can't buy it - surely that is the most important thing?

track selection is an important part of any demo. i'm sure many djs choose which tracks to put in their promos/demo. i like to get a mix if i think it's interesting, and got some good stuff on it. for instance the cloudskipper / no left turn / etc mixes. genre names aren't internationally standardised enough to know if i'll like something. if i'm going to spend ages downloading a mix (on my 56K), i want it to be a mix that i will appreciate and enjoy listening to.
but i think it's more than fair if silver chooses not to allow the publishing of tracklists on his web space. he seems to allow linking to off-site tracklists so that's ok.
personally i think it helps hardcore sales to have tracklists. i have went out and bought a MASSIVE amount of tracks that i've heard in mixes. similarly, i've NOT bought many tracks that i would like to because i have no idea what they are as no tracklist comes with them. so i think it's the opposite, but again it's fair enough to make those rules on your site if you wish!

keep it on the safe side and don't bother with tracklistings. 2 points
1. its unlikely that a mix will be posted on this site only,it'll spring up on ush and other places where tracklistings are allowed. or if it doesn't....
2. if ya wanna know what a track is then ask whoever did the mix what it is in pm
