Ok I’m sure this has been covered somewhere on this forum before my curiosity is so overwhelming I just have this bring this up again. When a sample is used on a hardcore track like a female voice on a happy tune or hip hop voice on a dark tune or sound sample from any tune, even a sample from a tv program or film do the hc producers have to pay royalties or do they just release the track fingers crossed the copyright lawyers don’t come after them?

Yes and no, usually when you for example take a clip from a movie, they dont sue you, if your not making money with the tune. Its pretty much the same thing as it is with mixtapes. But it still is "illegal" if they dont pay royalties... Thats what i think, so i'm not 100% sure...

i think if you use a straight up sample from somewhere than you CAN get sued but if you **** with that sample in the least bit(ie;re-arrange,speed up,ect..) than they cant **** with you

no, its still a sample, if its been played around with or not
hardcore goes under the radar most of the time so illegal samples are generally not noticed
most labels will make the producer sign something saying they are personally responsible for the legallity of the track so they dont get sued

There is this myth that if you only use x seconds of a sample it's fine... that is totally incorrect.
There is another that says if you change x percent of the sample it's fine... that is totally incorrect.

I know that silver would know more, but I heard this "myth" on the radio. As in to conform that it could be true.
As in you can you x% of a sample and not have to declare it....
Is there any proof either way??

certainly in the UK (I couldn't comment on any other country) but if you use any piece of music.... theoretically just one note!!! (although this takes things a bit far) then you have copied it.... and hence are infringing someone else's copyright.... even if you disguise it so much, then it is still subject to copyright in legal terms.... the only reason this myth exists is because if it is disguised so much, who is going to be able to tell where it came from? hence nobody notifies their lawyers coz they don't know its there.

yea, it's illegal to take any tiny clip without clearance. but most of the time the record will go by unnoticed.. even if the producers do find out, it won't be worth their time and effort to sue you, (unless your track is huge) as legal costs would be more then the money they could sue you for.

while we're here, does anyone know how long it takes before a tune loses it's copy right and you can do whatever you want with it? Ive heard 10, 15, 20 and 100 years, so im uncertain. would make sense because of scott browns supertramp ripoff :)
