I've got my own Radio Station as u probably all know & I have told the listeners in the forum not to post TL's in the DJ mixes section of the forum but I was wandering why this is such a problem. Is this illegal? Can someone help me out? Cheers

A tracklist is not illegal.... the mix is gray area and may get you an email / letter from labels, artists or publishers.

cheers silver, I told a few of the DJ on my site that they can't do it & they were wandering why as all the websites they've been on they could but seeing as i'm a HHC.com lad then i'll stick with u on this one silver. I don't want my station to make enemies!

If it's released tunes aren't you suppose to be allowed to post a tracklist?

there's a loophole:
make a jpeg containing track names - like a CD's back cover - upload it to... any site that lets you upload pictures, then link it to the desired website (in this case HHC.com or Narcotic radio)
that way your site can't be held accountable for information which is technically hosted on another site in the format of a picture.
i dunno. it works and kind of makes sense. and it makes the tracklist all pretty 'n' interesting to look at unless you make it boring black old and white.

you'd think that you'd be able to do that but unless it's licensed (aka you got permission from said artists), it's a grey area like silver said and looked at kinda like plagiarism.
probably some artists don't care and would even like it, others complain (even tho it's free promotion really. i know, i don't get it either)
so, to play it safe and keep everyone happy except the DJ, no tracklists are allowed.
so unless you made the track from scratch yourself, you ain't puttin' up a TL.

There isn't a loophole, it people can read it they may send you letters.

okay true, i did make a mistake.
but HHC.com does not block these types of images.
because of what i said, you (hhc.com) is able to cover it's butt in regards to potential legal ramifications, am i wrong?
basically your website can't be held responsible for user-posted images (unless they are of pornographic nature or something).

Lol its really not that hard to PM the dj who did the mix and ask for a tracklist really...
And im not supprised people get pissed off about mixes with there tracks uploaded in them its not hard to rip a tune from a mix....Il be the first to admitt iv grabbed rare tunes that way. But imo thats just as bad as posting the mix in the first place. So meh...

honestly, with most rare tunes, the DJ already made their money off them. all the original records sold, the producer got his $ and the record probably didn't get a second pressing, that's why it's in such high demand. you'd really only be lining someone else's pocket if you bought it used.
that's not to say everyone is entitled to a copy, but if a rip from a mix and your only alternative to paying a shit load of money for a used and hard-to-come-by record,then i say do what ya like, just no sharing. no this is not the same thing as filesharing if someone is going to try to jump on me for this.
i don't do this, but i don't see it as a problem either especially in that case. it's like the free clip you can listen to at IMO: crappy quality and not the whole track either

Cheers everyone, you're feedback has been greatly appreciated! I've never posted a Tracklist as it's the rules of the site but I never really knew why & now that i've got my own Radio Station with forums ect then I really had to know the ins & outs of it.
Were not long started & the last thing I want to do is piss off lot's of the producers & DJ's by handing their new tracks out in mixes with the titles plastered all over our forums. I wouldn't like my tracks getting handed around in DJ mixes unless they were from a by gone scene. I understand how hard it is for hardcore producers to make money these day's with all the filesharing going on & I don't want to come across like were promoting it. Thanks again people;-)

I haven't been posting tracklists due to the whole label reason for my latest mixes on Youtube from advice off Cotts but really, i don't think i've had any trouble before...
But then again i don't tend to check my messages...
And also, i guess tracklists increase piracy as the little limewire kiddies will know what to search for.

It kinda depends.
Speaking from a producer's perspective... each track (signed or not) would be okay to have in a mix depending on the quality...
I wouldnt want a 320 kb mp3 mix posted up with it advertising the fact that my track is it in... then again, id ask for it to be removed if it was that high quality.

We only allow tracklists if:
1. If all the tracks have something to do with the DJ mixing it, their tracks or are remixes by that artist*.
2. It's 100% licensed.
3. The DJ mixing it are runming from a label that the DJ owns and all the tracks are from that label or something like that.
4. They have permission from the artists / publishers etc (crush on hardcore etc...)
We also remove images if you post a tracklist.
You also have to remember there are basically three people that have "rights" to any track, the artist, the publisher and the copyright holder, this can be anywhere between 1 and 3 people most of the time it's 2 people and sometimes all these people don't talk to each other so if you get a 100% no problems from one of them it wont help you when another "rights" person sends you an email. This was one of the reason one of the "discs" of crush on hardcore vol 1 was quickly removed from download a few hours after release.
* Yeah technically I know the remixer has no rights but we draw the line there because it's assumed that the when you get a DJ to remix a tune they are going to play it out.

Yeah I don't post tracklists for any of my youtube stuff or any mixes. People bang on all the time about wanting to know what track is what but honestly I don't want any trouble..
As I said to Ravine its really not worth it.
