Recieved this email today from the man himself........
____________________________________________________________________________
After an in depth investigation into the recent file sharing of our Hardcore Energy 2 album on various worldwide file sharing communities, we have reason to believe the download you purchased was used in an illegal manor. We have been working closely with 2 of the main file sharing sites to match IP addresses and gain personal information. We are now passing this information onto the BPI, MCPS and PRS for further investigation. They will take the necessary legal action to ensure this does not happen again.
If you believe this to be in error please contact me right away. Similarly, if you did upload this album to any online community and have the respect to own up to it I may consider halting this action.
Regards,
Kevin Thorpe NEC.

I don't even know what sites it was on and i care enough about the hardcore scene to not fileshare and like i said to him in my reply, I don't fileshare. I'm very careful how i control my music and i'm pretty upset to have this sort of thing sent to me. I'm curious if they sent this to everyone who bought hardcore energy 2??

Did you download it illegally?
Dont think there's allot of strength behind his threat.
Just say that you believe it to be an error! haha
perhaps they are just playing scare tactics with whoever was uploading it. As if they can work closely with file sharing sites. Surely people who allow people to put links up on that site would be in the shit too. Doesnt make allot of sense to me.

If you didn't share anything, I wouldn't worry Vladel. IP checks are very unreliable. If it helps, I received this in my inbox as well; I sent a reply saying I haven't shared it but never got a response.
In a nutshell, shortly after HE2 was released it cropped up on a lot of filesharing forums; as a result, Kevin and Sharkey blew a few circuits about the whole deal (Sharkey even canceled the site he was planning on putting up). Not exactly the professional way of dealing with things.

If you where making a film and people stole it from you would you care about it? I'm sure you would. In the same way Sharkey & Kev Energy care about their music being stolen. I totally understand why Sharkey is doing what he is doing. Imagine if you put the best years of your life into a project only to have it stolen, repeatedly. I'm sure you'd be pissed off just like they are.
Obviously I don't know the system they have used to track down peoples IP's but I'm willing to bet that most of the people who have/will get this e-mail will deny it 100% regardless if they obtained it illegally or not. With regards to the two who have posted and received this e-mail, all you need to do is produce your e-mail receipt as evidence of purchase and you shouldn't have a problem.

having met both him and kevin, they really arent the guys you think they are, just had to be said - you have the wrong end of the stick.
there are a few "monie-hogs" in the scene, but they arent among them.
and i'm not just stepping forward to defend them because they are *stars* in the scene, as there are *stars* in the scene who i wouldnt lift a finger for..
but kevin and sharkey are decent human beings, they are well within their rights to follow up whats gone on with their album - i would say none of those emails should be taken the wrong way or in a bad light - unless the user had somthing to do with it. otherwise support the efforts..

He was accusing you of illegally sharing their content, not downloading yourself.
Also what DjTriquatra said.

IP checks are, but at least here if you file a criminal report, you get the exact info from ISP's, which holds ground even in courts. However, here, without a criminal investigation, you dont get anything, and rightly so.

you're going by what you've interpreted on the web, things can be misread and misunderstood, its very hard to say things against somthing without the "human" aspect - and all too easy to read too much into what a person says or their intentions.

I can a) imagine being massively fcuked off if someone's robbed my album, but I can also b) imagine being fcuked off if you get this message and you're not guilty.
A simple "Sorry to our loyal fans and supporters, but we felt the only way to approach this was to send this to everyone" message would have sorted everything out just fine.

the problem we have its like crying wolf.. they are high involved in a scene that isn't massively law abiding as it is... drugs, filesharing, pirate radios, illegal raves, producers/promoters ripping people off... in court it would be a case of..."hardcore"?... judge/bench.."laugh, laugh"... next case please...

It's done in general as well! Read in a magazine that there are quite a lot hackers out there, who break in to PCs of artists and producers. They steal tracks and put them on youtube months before release. Sometimes extortion happens as well, especially when selfmade porn was found on PC or the persons hacked private e-mail addresses and mobile number of stars like Lady Gaga. They don't look for special kind of music. It's more like a pretenter thing.
