Thankfully here, that type of crap wouldnt stand on court. E.g. if a softwares EULA says something, but you cant read it before you buy the product, the EULA couldnt be enforced infront of court. Also stuff that limits your use of the product (you cant use proxys, *******s etc) should be said clearly to me before i sign the contract (small print doesnt count). But naturally they will show you the EULA when you get broadband, but the company still has to follow laws, which here say that they can monitor my network traffic if there is evidence that i'm braking the law, it requires at least a report of an offence to the finnish police.
Also a FYI i'm not debating on who can download and what, i'm debating on civil liberties and my right not to get ****ed over by big companies, governmets and what not. And that means to me a lot more then some filesharing dudes getting away with it. That is one of the most important things for democracy to survive, and i would never submit my freedom for any price. On ne passe pas, as the french would say
